Deed –New York Conveyances.

Notes – This Indenture was registered 43 years after the event. Some parts were entered as just lines, with words missing. The deed was either damaged through time, or had been deliberately altered. It is known from a Kentucky Court case in 1817 - “The heirs of David Galbreath vs The heirs of John Stites”, that there was some sort of dispute between the England based Galbreaths and their American relatives over property (this is known from a newspaper notice in the Kentucky Gazette, the Scott County Court records being destroyed by fire). 

In a letter dated May 1835, David Galbreath’s daughter Cornelia talks in a letter to her brother John, about the “properties in America”, and that their brother David had traveled to America with certain “papers”. Also in the letter was the news that their brother David jnr. had died off Sandy Hook (off New Jersey near the entrance to New York). It is not known whether he was arriving in or departing America. The registration of this deed may have been at the behest of David, or by the current property owners when David started “enquiries”. The timing of the deed’s registration, 43 years late, with David’s visit seem “well timed”.

This Indenture made the twenty seventh day of June in the year of our Lord one thousand seven hundred and ninety one between David Galbreath of the City of New York Merchant and Cornelia of the one part and William Minturn of the said City Merchant of the other part 

Witnesseth that the said David Galbreath and Cornelia his wife for and in consideration of the sum of three thousand two hundred and forty five pounds current money of the State of New York to them in hand paid by the said William Minturn at or before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged have granted bargained sold aliened released and confirmed and by these presents do grant bargain sell alien release and confirm unto the said William Minturn in his actual possession now being by virtue of a bargain & sale to him th……………. made for one whole year by Indenture bearing date the day next before the date of these presents ________________ possession and to his heirs and assigns forever all that certain dwelling house and lot or parcel ________________________________ York in the East Ward of the said City on the North side of Queen Street fronting South to said Street ________________________bapet North by ground belonging to Hermanus Rutgers and East by the house and ground of Le ___________ Wilson containing in breadth fronting the said Street thirty feet eleven inches running from the front ____________________ one hundred and sixty eight feet ten inches making the front in breadth as aforesaid the ____________________ more or less _________________________ And also a slip of ground in the Easterly side of the said lot adjourning the house and groun_____________ five inches and two thirds of an inch and ninety four feet in length on the said slip ___________________ David Galbreath 

Together with all and singular the rights members and appurtenances _____________________ of ground and premises hereby granted and released belonging or in any wise appertaining and ______________ders rents issues and profits of the said premises hereby granted and every part and parcel thereof with ________ all the estate right title interest property ________________________ David Galbreath and Cornelia his wife of and in and to the same and of in and to every part and parc__________________________ to hold all and singular the said dwelling house lot or parcel and slip of ground hereditam_____________________ every part and parcel thereof with the appurtenances unto the said William Minturn his heirs ____________ of him the said William Minturn his heirs and assigns forever 

And the said David Galbreath for ­­­­­­­­­­­_________________________________ to and with the said William Minturn his heirs and assigns that he the said David Galbreath hath ____________________cured to be committed done or suffered any act matter or thing whatsoever whereby the said diver______________ part thereof may be in any wise charged or incumbered but that the said premises and every part thereof is free clear of and from all charges titles or incumbrances whatsoever committed done or suffered by him the said David Galbreath and Cornelia his wife or either of them and that the said William Minturn his heirs and assigns shall and lawfully may from time to time and at all times forever hereafter peaceably and quietly have hold use occupy possess and enjoy all and singular the said premises with the appurtenances without the lot suit trouble execution ejection hindrance or denial of them the said David Galbreath and Cornelia his wife or either of them or any person or persons claiming or to claim by from or under them 

And also the said David Galbreath for himself and his heirs doth covenant and agree with the said William Minturn his heirs and assigns that he the said David Galbreath and his heirs shall and will at all times at the reason ______________________________heirs and assigns make do and execute cause or procure to be made done and executed all such further _______________________________ for the better further and more perfect granting and conveying and assuring the said premises to him the said ___________ Minturn his heirs and assigns or his or them counsel learned in the law shall be reasonably required _____________ his heirs executors and administrators the said hereby granted and released premises and every part and parcel thereof with the appurtenances unto the said William Minturn his heirs and assigns against the said David Galbreath his heirs and assigns and against all and every other person and persons claiming or to claim by from or under them shall and will warrant and forever by these presents defend

Sealed and delivered in the presence of us Note the words “and” on the twelfth line “in” on the 13th and “?art” on the 23rd line were wrote on razures before execution

Be it remembered that on the twenty seventh day of June in the year of our Lord one thousand seven hundred and ninety one personally appeared before me John Ray one of the Masters in Chancery for the State of New York David Galbreath and Cornelia his wife the grantors in the within release named who severally acknowledged that they did sign seal and deliver the same as and for their voluntary act and deed for the uses and purposes therein mentioned And the said Cornelia being examined by me privately and apart from her said husband acknowledged that she executed the same of her free will and accord without any threats or compulsion from her said husband and I having inspected the said Indenture of Release and finding no material rasures or interlineations therein other than those noted to have been made before the executing do allow the same to be recorded
