Franklin County Courthouse, Columbus, Ohio, (Delaware County), Vol. A pg 84a David Galbreath et al This Indenture made this eighth day of December in the
year of our Lord one thousand eight hundred and two between David Galbreath late
of the City of New York and Thomas Elmes now of the same place of the one part
and Joseph Constant of the same city of the other part Witnesseth that whereas in pursuance of several Acts of
Congress heretofore passed for that purpose the President of the United States
did in virtue of the power and authority in him vested issue Letters of Patent
to and in the name of the said David Galbreath and Thomas Elmes granting and
conveying to them Now therefore this Indenture witnesseth that the said
David Galbreath and Thomas Elmes for and in consideration of the sum of two
thousand dollars to them in hand paid by the said Joseph Constant at and before
the ensealing and delivery of these presents the receipt whereof is hereby
acknowledged have granted bargained sold conveyed and confirmed and by these
presents do grant bargain sell convey and confirm unto the said Joseph Constant
and to his heirs and assigns all the before mentioned and described fourth
quarter of the fourth township in the eighteenth range in the tract aforesaid
estimated to contain four thousand acres To have and to hold all and singular
the said tract of land and premises with the appurtenances unto the said Joseph
Constant his heirs and assigns to and for his and their own proper use benefit
and behoof forever And the said David Galbreath and Thomas Elmes for
themselves their heirs executors and administrators do covenant and agree to and
with the said Joseph Constant his heirs executors administrators and assigns
that they the said David Galbreath and Thomas Elmes now have in themselves full
power and lawful authority by these presents to grant bargain sell and convey
the said tract of land with the appurtenances unto the said Joseph Constant his
heirs and assigns in manner aforesaid in fee simple according to the true intent
and meaning of these presents and that free and clear of all incumbrances
whatsoever In witness whereof the parties to these presents have
hereunto set their hands and seals the day and year above written the words
“in the eighteenth range” in the thirteenth line 1st page
