David Galbreath
Deed to
Joseph Constant 

This Indenture made this fourth day of February in the year of our Lord one thousand eight hundred and three between David Galbreath late of the City of New York Merchant of the one part and Joseph Constant of the same place Counsellor at Law of the other part 

Witnesseth that whereas in pursuance of several Acts of Congress heretofore passed the President of the United States did in virtue of the power and authority in him vested issue Letters Patent to and in the name of the said David Galbreath and Thomas Elmes granting and conveying to them the fourth quarter of the fourth township in the eighteenth range of the tract appropriated for satisfying warrants for military service estimated to contain four thousand acres and whereas the said Thomas Elmes on the eight day of December last past did execute deeds of conveyance for the said land and deliver the same to the said Joseph Constant not only for himself but as the attorney of the said David Galbreath and whereas doubts have arisen whether the said Thomas Elmes was lawfully impowered to execute said deeds of conveyance for and in behalf of the said David Galbreath 

Now therefore this Indenture witnesseth the said David Galbreath for and in consideration of the premises and in the further consideration of the sum of one dollar to him in hand paid by the said Joseph Constant at and before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained sold conveyed and confirmed and by these presents doth grant bargain sell convey and confirm unto the said Joseph Constant and to his heirs and assigns all right interest and title of him the said David Galbreath of in and to the before mentioned and described tract of land and to every part and parcel thereof with the appurtenances To have and to hold all and singular the right interest and title of him the said David Galbreath in and to the said tract of land and premises with the appurtenances unto the said Joseph Constant his heirs and assigns to his and their own proper use benefit and behoof forever 

And the said David Galbreath for himself his heirs executors and administrators covenant and agree to and with the said Joseph Constant his heirs executors administrators and assigns that he the said David Galbreath and Thomas Elmes had on the eighth day of December last in  themselves full power and lawful authority to convey the said land in fee simple free and clear of all incumbrances whatsoever and that the said David Galbreath hath not since the said eighth day of December last done any act or thing to alter injure incumber or impair his right interest and title in and to the said land 

In witness whereof the parties to these presents have hereunto interchangeably set their hands and seals the day and year above David Galbreath (seal)

On the twenty first day of April in the year one thousand eight hundred and three personally  came before me John Kemp who by the oath of John Taylor of the City of New York Merchant proven to my satisfaction to be the same person and he being duly sworn did depose and say that he saw David Galbreath known to him to be the same person who is described in and who executed the within conveyance execute the same and that he set his name thereto as a subscribing witness..(unclear)… to me satisfactory proof of its execution and finding therein ..(unclear)… I do allow it to be recorded
