David Galbreath - property dealings


 
This Indenture, made this eighth day of December in the year of our Lord, one thousand eight hundred and two, between David Galbreath, late of the City of New York and Thomas Elmes, now of the same place, of the one part, and Jonas Stanberry, of the same city, gentleman, of the other part. Witnesseth that whereas in pursuance of several acts of Congress heretofore passed for that purpose, the President of the United States did in virtue of the power and authority in him vested issue letters of patent to and in the name of the said David Galbreath and Thomas Elmes, granting and conveying to them the second quarter of the second township in the eighteenth range of tract appropriated for satisfying warrants for military services. Now, therefore this Indenture, witnesseth that the said David Galbreath and Thomas Elmes for and in consideration of the sum of two thousand dollars to them in hand paid by the said Jonas Stanberry at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged, have granted, bargained, sold, conveyed and confirmed and by these presents do grant, bargain, sell, convey and confirm unto the said Jonas Stanberry, and to his heirs and assigns, all the before mentioned and described second quarter of the second township in the eighteenth range of the tract aforesaid, estimated to contain four thousand acres. To have and to hold all and singular the said tract of land and premises with the appurtenances unto the said Jonas Stanberry, his heirs, and to and for his and their proper use, benefit and behoof forever. And the said David Galbreath and Thomas Elmes for themselves, their heirs, executors and administrators, do covenant and agree to and with the said Jonas Stanberry, his heirs, executors, administrators and assigns, that they, the said David Galbreath and Thomas Elmes, now have in themselves full power and lawful authority by these presents to grant, bargain, sell, release, convey and confirm the said one quarter township of land with the appurtenances unto the said Jonas Stanberry his heirs and assigns in manner aforesaid according to the true intent and meaning of these presents and that free and clear of all incumbrances whatsoever. In witness whereof the parties to these presents have hereunto set their hands and seals the day and year above written.

In this ninth day of December 1802 before me, personally came Thomas Elmes, also David Galbreath by the said Thomas Elmes, his attorney, within named, to me known, who duly acknowledged that they executed the within deed for the uses therein mentioned and there being no material erasures or interlineations therein I do allow it to be recorded.
