David Galbreath and Thomas Elmes
and
William Wells

This indenture made the eighteenth day of September in the year of our Lord eighteen hundred and one between David Galbreath and Thomas Elmes of the City of New York Merchant of the first part and William Wells of Zanesville in the territory of the United States north west of the Ohio Esq. of the second part witnesseth that the said David Galbreath and Thomas Elmes in consideration of five thousand dollars to them in hand paid by the said William Wells the weight whereof is hereby acknowledged hath granted bargained sold and by these presents doth grant bargain and sell to the said William Wells and to his heirs and assigns forever all that certain tract piece and parcel of land estimated to contain four thousand acres being the second quarter in the first township and twelfth range and also all that other tract piece and parcel of land estimated to contain four thousand acres being the second quarter in the second township and tenth range both of which tracts of land are situated lying and being in the territory north west of the river Ohio within the tract of land appropriated by congress for satisfying warrants for military service subject to the conditions restrictions and provisions contained in the act of congress passed on the first day of June seventeen hundred and ninety six entitled an act regulating the grant of land appropriated for military services and for the Society of United Brethren for propagating the gospel among the heathen and of the several acts supplementary thereto passed on the second day of March seventeen hundred and ninety nine and on the eleventh day of February and first day of March eighteen hundred. To have and to hold unto the said William Wells his heirs and assigns forever. And the said David Galbreath and Thomas Elmes for themselves theirs heirs executors and administrators doth hereby covenant and grant to and with the said William Wells his heirs and assigns that them the said David Galbreath and Thomas Elmes are seized to the above mentioned premises of a good indefeasible estate of inheritance in fee simple and that they have full power to sell the same in the manner above mentioned and that the same is free of all incumbrance by them made thereon and that the said David Galbreath and Thomas Elmes and their heirs shall and will forever hereafter warrant and defend the same to the said William Wells his heirs and assigns against all lawful claim and demand by any person or persons whatsoever had or made thereto and that the said David Galbreath and Thomas Elmes and their heirs will at the expense of the said William Wells and his heirs execute and acknowledge to him or them such further deeds as may be necessary to convey the aforementioned premises to him. In witness whereof the parties to these presents have hereunto set their hands and seals the day and year first herein written

on this eighteenth day of September 1801 before me personally came Thomas Elmes to me known to be the person described in and who executed the within conveyance who duly acknowledged that he executed the same and on the same day and year personally came the said Thomas Elmes who I am satisfied is the attorney of David Galbreath one other of the persons described therein who also duly acknowledged that he execute the same as the act and deed of the said David and their being no material erasure or interlineations therein I do allow to be recorded.
