Pleas to the People of the State of
New York of the term of October & November in the year of our Lord one
thousand seven hundred and eighty eight witness Richard Morris Esqr.

David Galbreath and Thomas Galbreath put in their
place Leonard Gansvort junr their Attorney against John Christie in a
plea of debt …. Be it remembered that heretofore that is to say in
the term of July in ….. last past before the People of the State of New
York at the City of Albany came David Galbreath and Thomas Galbreath by
Leonard Gansesvoort junr. Their Attorney and brought here into the Court
of the said People then there their certain Bill against John Christie
being in custody &c. of a plea of debt and …… pledges for prosecuting
namly John Dee and Richard Roe ……. Followeth in these words to wit .
Albany fs. David Galbreath and Thomas Galbreath complain of John
Christie in custody &c. of a plea that he render to them thirty six
pounds and nine pence lawful money of New York which the said John owes
to the said David and Thomas and unjustly detains from them for this to
wit that whereas the said John on the twenty first day of July in the
year of our Lord one thousand seven hundred and eighty seven at the City
of Albany in the County of Albany by his certain note in writing sealed
with the seal of the said John and to the Court of the People of the
State of New York now here shewn the date whereof is the same day and
year aforesaid did promise to pay to the said David and Thomas the said
thirty six pounds and nine pence on demand for value received by the
said John Nevertheless the said John although often required &c hath not
yet paid the said thirty six pounds and nine pence to the said David and
Thomas but hitherto hath refused and still doth refuse to pay the same
to them to the damage of the said David and Thomas fifty pounds. And
thereof they bring suit &c. And now at this day that is to say on
Wednesday the twenty ninth day of October in this same term until which
day the said John had leave to imparle to the said Bill and then to
answer thereto before the People of the State of New York came the said
David Galbreath and Thomas Galbreath by their said Attorney and the said
John …….. at the same day solemnly demanded does not come but …………………..
and does not say any thing in bar or denial of the said …. The said
David and Thomas whereby the said David and Thomas remain therein
undefended against the said John Therefore it is considered that the
said David and Thomas ……… against the said John their said debt and also
five pounds …………….. ten pence …. Penny for the damages which they have
sustained as well by reason of detaining their said debt as for their
costs and charges by them expended about their suit in that behalf
adjudged to the said David and Thomas by the Court of the said people
now here with t….. and the said John in mercy &c.
