Deed - Phillip DALLIE - 1713


Recorded for Joseph Latham & Phillip Dallie the third day of February anno dom 1715.
 
This Indenture made the fifteenth day of January in the twelfth year of the reign of our Sovereign Lady Anne by the grace of God of Great Brittain France and Ireland Queen Defender of the Faith &c. and in the year of our Lord one thousand seven hundred and thirteen
Between Johannes Beekman of the City of New York yeoman & Altie his wife of the one part and Joseph Latham & Phillip Dallie both of the same City shipwrights of the other part
 
Witnesseth that the said Johannes Beekman by and with the consent ond good liking of Altie his said wife signified by her being a party to these presents and her signing sealing & delivery of the same for and in consideration of the sum of fifty one pounds currant money of New York to them or one of them well and truly in hand paid before the ensealing & delivery of these presents the receipt whereof from them the said Joseph Latham & Phillip Dallie they do hereby acknowledge and themselves to be therewith fully satisfied contented & paid & thereof & therefrom and of and from all and every part & parcel thereof they do acquit exonerate and discharge them the said Joseph Latham and Phillip Dallie their heirs Ex’s & assigns by these presents Have given granted bargained sold conveyed enfeofed assured and confirmed and do by these presents give grant bargain sell convey enfeoff assure and confirm unto them the said Joseph Latham & Phillip Dallie their heirs and assigns for ever
 
All those two lotts or parcells of land situate lying & being within the City of New York aforesaid fronting South to Queen Street West to a Street lately projected commonly called Beekman Street North to the rear of a range of lotts which fronts northerly to Van Clyffs Street and on the East by other lotts of land of the said Johannes Beekman or his assigns and contains in breadth front and rear each end fifty foot and in length one hundred foot and are distinguished in a certain Deed of partition and draft or chart of the lands of William Beekman Esq’r deceased made betwixt his heirs & legatees dated the seventh day of September anno dom one thousand seven hundred & eight by the name or names of the lotts No. 11 & 12 as by the said Deed of partition and chart or draft referrance being thereunto had may more fully and at large appear and the reversion and reversions remainder and remainder rents issues and profits thereof and all the estate right title use possession claim and demand whatsoever of them the said Johannes Beekman and Altie his wife of in or to the same or all or any part or parcel thereof

To have and to hold the above bargained premises and every part and parcell thereof with the appurtenances to them the said Joseph Latham & Phillip Dallie to the uses intents and true meanings of them the said Joseph Latham & Phillip Dallie as they are hereafter exprest and to no other use whatsoever (that is to say) the one undivided moiety or half part or share thereof to him the said Joseph Latham his heirs & assigns for ever and the other undivided moiety or half part or share to him the said Phillip Dallie his heirs and assigns for ever And the said Johannes Beekman and Altie his wife for themselves their heirs Ex’s Adm’s do covenant promise grant and agree to & with the said Joseph Latham and Phillip Dallie their & each of their heirs Ex’s Adm’s and assigns in manner and form following (viz.) that they the said Johannes Beekman & Altie or one of them at the time of the ensealing and delivery of these presents are or is, and, until a good perfect & absolute estate of inheritance of all & singular the above bargained premises with the hereditaments & appurtenances & every part & parcell thereof shall be fully vested settled and executed in & upon the said Joseph Latham & Phillip Dallie their heirs and assigns forever according to the use and uses above in these presents expressed shall remain continue and be seized of an in the said parcells or lotts of land and premises hereby granted with the appurtenances & every part and parcell thereof of a good pure perfect & absolute estate of inheritance in fee simple without any condition or limitation of any use or uses estate or estates whatsoever to alter change charge defeat determine or make void the same And that the said Johannes Beekman and Altie his wife at the time of the ensealing & delivery of these presents have or some or one of them hath full power good right & absolute authority to grant bargain sell and convey the said bargained premises with the appurtenances & every part and parcell thereof unto them the said Joseph Latham and Phillip Dallie their heirs and assigns forever And that the said Joseph Latham and Phillip Dallie their heirs and assigns and every of them shall and may at all times hereafter lawfully quietly and peaceably have hold use occupy possess and enjoy the said tract of land and premises with the appurtenances and every part and parcell thereof & have & take the rents issues and profits thereof to their or some of their proper use behoofe and benefit forever without any lawfull let suit eviction denial or interruption of the said Johannes Beekman & Altie his wife their heirs or assigns or any other person or persons whatsoever lawfully claiming or to claim by from or under them or either of them and that free and clear & freely and clearly acquitted exonerated and discharged saved & kept harmless by them the said Johannes Beekman and Altie his wife & their heirs of & from all former and other bargains sales gifts grants mortgages joyntures dowers recognizances extents judgments executions entails and all other titles incumbrances & demands whatsoever had made done or suffered by the said Johannes Beekman & Altie his wife or any other person or persons whatsoever And that the said Johannes Beekman and Altie his wife & their heirs the said bargained premises with the appurtenances and every part thereof unto them the said Joseph Latham and Phillip Dallie their heirs & assigns forever shall & will warrant and forever defend by these presents

Received then of Joseph Latham & Phillip Dallie parties to these presents the sum of fifty one pounds currant money of New York in full of the consideration money within mentioned for the within bargained premises wee say received by us John Beekman Aeltye Beekman
Witness thereof Willhelmus Beekman Wm Huddleston New York the twenty fifth day of January anno dom one thousand seven hundred and thirteen then came personally before me Abraham Wendell Esq’r one of her Majesties Justices of the Peace for the City & County of New York the within mentioned Johannes Beekman & Aeltie his wife parties to the within written conveyance & declared that they did sign seal and deliver the same to the use & uses within mentioned as their and each of their voluntary act & deed
