Joseph Egbert Clerk John Dally & uxor to Paulus Richards
To all Christian to whome this present writing shall come John Dally of
Staten Island yeoman & Elizabeth his wife send greeting in our Lord God
everlasting know yee that the said John Dally & Elizabeth his wife for &
in consideration of the sum of eighty two pounds ten shillings currant
silver money to him in hand paid at & before the ensealing & delivery
hereof by Paulus Richards of the City of New York merchant the receipt
whereof is hereby acknowledged & thereof & of every part & parcell thereof
the s’d John Dally & Eliz’h his wife doe hereby acquit exonerate &
discharge the said Paulus Richards his executors administrators & assigns
have granted bargained sold assigned & sett over and by these presents doe
fully clearly and absolutely grant bargaine sell assigne & sett over unto
the said Paulus Richards all that certain lott or parcell of land now in
the possession & occupation of him the said John Dally scituate lying &
being on Staten Island next & adjoining to the land of Richard Stillwell
on the southward & on the northward by the highway within the bounds &
limits of the Newtown as by ascertained patent thereof under the sale of
the province of New York relacon thereunto being had may more fully & att
large appeare together with all & singular the houses edifices buildings
barnes stables fencing & improvements whatsoever thereupon now being on
that shall att any time or times hereafter be thereon built or erected
To have and to hold the said lott parcell of land & all & singular other
the premises with their appurtenances unto the said Paulus Richards his
heirs & assignes to the sole & only proper benefitt use & behoof of him
the said Paulus Richards his heirs & assignes for ever And he the said
John Dally for himself & she s’d Elizabeth his wife theire heires
executors and administrators doth covenant promise & grant to and with the
said Paulus Richards his executors administrators & assignes in manner &
forme following (that is to say) that he the said John Dally & Elizabeth
his wife or one of them is or are at the time of the ensealing & delivery
of these presents lawfully seized of & in all & singular the before
bargained promises of a good sure lawfull perfect & absolute estate of
inheritance in ………… without any trust use condicon limitacon or
incumberance whatsoever to defeat incumber evict or make void the same And
that he the said John Dally & Elizabeth his wife & theire heires executors
administrators all & singular the before bargained premises every part &
parcell thereof to him the said Paulus Richards his heires executors &
administrators & assignes against him the said John Dally & Elizabeth his
wife theire heires executors administrators and every of them & all person
or persons claiming or to claime by from or under him them or any of them
shall & will warrant & for ever defend And also that he the said John
Dally & Elizabeth his wife theire heires executors administrators shall
and will from time to time at at all times hereafter during the space of
seven years upon the reasonable request & att the costs & charges in the
law of the s’d Paulus Richards his heires executors administrators and
assignes make doe perform & execute such further & better assurances &
conveyances in the law as by the said Paulus Richards his heires executors
administrators or assignes or his or theire council learned in the law
shall reasonably be devised or devised & required for the better and more
perfect assuring sure making and conveying of all and singular the afire
bargained premises unto the said Paulus Richards his heires executors
administrators & assignes provided allways that the person or persons soe
to be required to make such further assurance be not complelled or
compellable to travell further then seaven miles from his or theire
dwelling house or habitation for the doing or executing thereof
In witness whereof the s’d John Dally & Elizabeth his wife have hereunto
sett theire hands & seales this thirteenth day of October anno dom 1685 &
in the first yeare of the reigne of … Soveraigne Lord James the Second by

delivered in the presence of Sam’l Winder. Edward Tailor. The within named
John Dally & Elizabeth his wife personally appeared before me John Palmer
Esq. one of the Judges of the Court of Oyer & Terminer & gen’ll Gaole
delivery on the day of the date of the same declared this instrument
within written to be theire act & deed & she s’d Elizabeth was likewise
privily examined who declared that the same was done by her free &
voluntary consent without any threats or compulsion of her husband J
