Deed – New York Coneyances. Deed Book 54, pgs 393 Recorded for and at the request of Jacob Seber this 9th
day of June 1797 This Indenture made the eighteenth day of September in the
year of our Lord one thousand seven hundred and ninety three between John Stites
of Elizabeth Town in the State of New Jersey and Susannah his wife of the first
part and Jacob Seber of the City of New York Merchant of the other part Witnesseth that the said John Stites and Susannah his wife
for and in consideration of the sum of four thousand three hundred dollars to
them in hand paid by the said Jacob Seber the receipt whereof is hereby
acknowledged have granted bargained sold aliened enfeoffed conveyed and
confirmed and by these present do grant bargain sell alien enfeoff convey and
confirm unto the said Jacob Seber his heirs and assigns forever all that certain tract of land situate lying and being in
the County of Tioga and State of New York being seventeen lots videlict lots
numbers fifty eight, fifty nine, sixty six one, sixty six two, sixty three,
sixty four, sixty five, seventy five, seventy six, seventy seven, seventy eight,
seventy nine, eighty, eighty four, eighty five and eighty six being in the South
half of township number eleven of the twenty townships laid out for sale on the
West side of the Unadilla River as the said lots are bounded and described in
the map and field book thereof filed in the Secretarie’s Office copies of
which are in the possession of the Proprietors and containing each lot two
hundred and sixty two acres in all four thousand and three hundred and fifty
four acres be the same more or less together with all the rights members and appurtenances
thereof and all house outhouses buildings fences orchards gardens improvements
trees timbers woods water water courses easements profits commodities emoluments
and advantages whatsoever to the same belonging or in any wise appertaining And
the reversion and reversions remainder and remainders rents issues and services
of all and singular the above mentioned premises And all the estate right title
dower interest claim and demand both in law and equity of them the said parties
of the first part of in and to the same premises and every part and parcel
thereof with their and every of their appurtenances To have and to hold unto the said Jacob Seber his heirs and
assigns to the only proper use and behoof of the said Jacob Seber his heirs and
assigns forever and the said John Stites for himself his heirs executors and
administrators doth covenant promise and agree to and with the said Jacob Seber
his heirs and assigns that at and immediately before the ensealing and delivery
of these presents he the said John Stites is the true and lawful owner and
proprietor of all and singular the said premises and the appurtenances hereby
granted and conveyed or so intended to be and that he is seised thereof of and
of every part thereof of a good pure and indefeasible estate of inheritance in
fee simple free of and from all manner of incumbrances title or charges
whatsoever And that he has good right full power and absolute authority to grant
bargain and sell the same unto the said Jacob Seber his heirs and assigns in
manner as aforesaid And also that he the said John Stites and his heirs the
hereby granted premises and every part thereof with the appurtenances unto the
said Jacob Seber his heirs and assigns will warrant and forever defend against
all persons whomsoever by these presents In witness whereof the parties have interchangeably set
their hands and seals the day and year first above written Sealed and delivered in the presence of us by the within
named By the within named Susannah Stites in presence of John Ray
and Mitchell received on the day and year within written for the within named
Jacob Seber the sum of four thousand and three hundred dollars being the full
consideration money within mentioned Be it remembered that on the eighteenth day of September in
the year of our Lord one thousand seven hundred and ninety three before me John
Ray one of the Masters in Chancery for the State of New York personally appeared
John Stites and Susannah his wife severally acknowledged they signed sealed and
delivered the within Indenture as their voluntary act and deed for the uses and
purposes therein mentioned and the said Susannah being examined by me privately
and apart from her said husband acknowledged she executed the same without any
fear threat or compulsion of her said husband and their appearing no material
erasure or interlineations in the said Indenture I do allow the same to be
recorded ------------------------------------------------------------------------------------------------------------------- This deed was recorded as John Stiles and not John Stites. However the following deeds in the Secretary of State’s Office, New York*, confirm that township 11 and other Tioga properties were sold and bought by John Stites. *Secretary of State - New York - Deed Books 24, pgs 217, 25/129, 25/137, 25/150. This mis-transcibing of John Stites’s name as Stiles is quite common. To prevent further perpetuation of the incorrect spelling in this deed, I have amended the spelling in this transcription to reflect the true name of John Stites. LDS Film # 888350 |
