The Last Will and Testament

of Catherine Galbreath  -  1842

This is the Last Will and Testament of Catherine Galbreath of London Road in the town of Brighton I give devise and bequeath unto Thomas Dakin of King William Street and Richard Rowe of Arthur Street West both in the City of London

upon trust all and every my household furniture linen wearing apparel books plate pictures china and also all and every sum and sums of money which may be in my house or about my person or which may be due to me at the time of my decease and also all other my monies invested in stock funds and securities for money book? debts money or bonds bills notes or other securities and all and every other my estate and effects whatsoever and wheresoever both real and personal whether in possession reversion (some words then unclear) under the will of my late father Thomas Galbreath of Colebrook Row in the Parish of Islington or any reversion remainder or expectance? unto the said Thomas Dakin and the said Richard Rowe upon this / the interests benefits and advantages arising therefrom to and for the sole and separate use of my sister Eliza Fiddes the wife of James Fiddes of Wellington Road in the Parish of St Marylebone in the County of Middlesex during her life the same to be free from debts control or engagements of her husband and her receipt for the same shall be sufficient discharge for the same not withstanding her coverture

and after her decease upon further trust to pay the dividends and interests to her husband James Fiddes for his life and after their decease to pay or transfer or devise any stock or monies which the said Thomas Dakin and Richard Rowe may then be possessed or hold in trust unto the children of the said James and Eliza Fiddes equally among them and the issue of such children such issue to take only their parents share and the residue of my personal estate of whatsoever nature or kind I give and bequeath unto the children of the said James and Eliza Fiddes after their death to be equally divided among them

and I nominate constitute and appoint Thomas Dakin and Richard Rowe aforesaid to be the executors of this my will and hereby revoking all former or other wills and testaments by me at any time heretofore made I declare this to be my Last Will and Testament In witness whereof I the said Catherine Galbreath have to this my Last Will and Testament set my hand the Catharine Galbreath day of (blank) in the year of our Lord one thousand eight hundred and forty Catharine Galbreath sixteenth day of April 1841. Signed by the Testator in the presence of us who have hereunto subscribed our names as witness in the presence of each other witness Elizabeth Smith Mary Smith

In the Prerogative Court of Canterbury. In the goods of Catharine / in the Will written Catharine Galbreath Spinster deceased

Appeared personally Mary Smith (wife of William Smith) of No 26 Western Cottages Brighton in the County of Sussex and referring to the Last Will and Testament of the said Catharine (in the said Will written Catherine Galbreath late of London Road in the town of Brighton in the County of Sussex Spinster deceased bearing date the sixteenth day of April one thousand eight hundred and forty one aforesaid by signing her name at the foot or end thereof in the presence of this deponent and of Elizabeth Smith the other subscribed witness thereto whom was present at the same time and that she this deponent and the said Elizabeth Smith thereupon attested and subscribed the said Will in the presence of the said deceased and she further made oath that the said deceased in executing her said Will as aforesaid inadvertently signed her name in the space left for the day of the date thereof and afterwards again signed her name at the foot or end thereof as aforesaid and added the words and figures "sixteenth day of April 1841" as now appears thereon Mary Smith On the fourteenth day of May one thousand eight hundred and forty two the said Mary Smith was duly sworn to the truth of this affidavit by virtue of the annexed Commission before me H.M. Wagner Vicar of Brighton in the County of Sussex Commissioner

Proved at London 20th May 1842 before Worshipful John Danberry Doctor of Laws and Surrogate by the oaths of Thomas Dakin and Richard Rowe the executors to whom administration was granted having both been first sworn only to administer.
