The Last Will and Testament of

Mary Spitty - 1743

In the Name of God Amen I Mary Spitty of South Benfleet in the County of Essex now being aged and infirm of body but of sound and disposing mind and memory calling to mind the uncertainty of human life do make and ordain this my Last Will and Testament in manner following

First and principally I commend my soul to God that gave it, and my body to the earth to be decently buried at the discretion of my executors hereafter named, and as touching such worldly estate as God of his mercy hath been pleased to bestow on me I dispose of the same as followeth , first I will that all such just debts as I shall owe at the time of my decease be duly paid

Also I give unto my eldest son John James having been already provided for by my former husband John James five shillings

Also I give unto my son Samuel James all that my freehold messuage tenement or farm called Westwick or otherwise situate lying and being in Canvey Island and in the Parish of Prittlewell in the said County of Essex with the lands and appurtenances thereunto belonging

And also those my copyhold lands called Suttons or otherwise lying and being in South Benfleet aforesaid and holden of the Manor of South Benfleet and now in the possession of my son Samuel James his assign or assigns together with all and singular the appurtenances thereunto belonging I give devise and bequeath unto him the said Samuel James his heirs and assigns forever

Also I give devise and bequeath unto my daughter Mary Rutter all that my cottage or tenement called Butcher's House or otherwise and the yard garden or orchard and appurtenances thereunto belonging situate lying and being in the Parish of South Benfleet aforesaid and in the occupation of her the said Mary Rutter and John Durrent to hold the said cottage or tenement and premises with the appurtenances during the term of her natural life and after her decease unto my granddaughter Mary Rutter and her heirs forever

Also I give unto my said daughter Mary Rutter all the money which shall be due to me from my son John James at the time of my decease and also so much to be paid her out of the residue of my personal estate as shall make the aforesaid debt one hundred pounds

Also I give unto my said daughter Mary Rutter all my wearing apparel clothes and wearing linen

Also I give unto my said son Samuel James one gold ring and five pounds of lawful money of Great Britain

Also I give and bequeath unto my son Thomas Spitty one gold ring

Also I give and bequeath unto my son Ambrose Spitty a silver tankard and cup six silver spoons and six silver tea spoons one coral set in silver and one gold ring

Also I give unto Mary Butcher five shillings

All the rest and residue of my goods chattels ready money debts owing to me and all other personal estate whatsoever not before disposed of and after my debts and funeral charges paid deducted and discharged I give and bequeath the same unto my son Ambrose Spitty

Also I nominate my friend Mr Francis Sewell of Pitsey (Pitsea) and my said son Samuel James joint executors of this my Last Will and Testament hereby revoking all former Wills by me made and in witness of this my Last Will and Testament I the said Mary Spitty have set my hand and affixed my seal the 10 day of December and in the year of our Lord one thousand seven hundred and forty one

Proved the second day of December in the year of our Lord one thousand seven hundred and forty three before the Reverend John Pick Clerk Master of Arts Surrogate to the Right Worshipful John Andrew Doctor of Laws ... Sequestrator General in the parts of Essex and Hertfordshire lawfully appointed by the oath of Francis Sewell and Samuel James the natural and lawful son of the deceased the executors to whom administration of all and singular the goods chattels and credits of the said deceased was committed they being first sworn upon the holy Evangelists well and faithfully to administer.
