Deed – Richard Spittie – 1703

This Indenture made the eleventh day of December in ye second year of the Reign of our Sovereign Lady Anne by the grace of God of England Scotland France and Ireland Queen Defender of the Faith Anno Dom 1703  

Between Richard Spittie of the Parish of Rettendon in the County of Essex gent of the one part And Henry Old of the parish of St. Martyns in ye fields in the County of Midd Turner of the other part  

Witnesseth that for and in consideration of ye sum of five shillings of lawfull money of England to the said Richard Spittie in hand payd by ye said Henry Old att or before ye sealing or delivery of this present Indenture ye receipt whereof he the said Richard Spittie doth hereby acknowledge And also in consideracon of the sum of one hundred pounds of like lawfull money of England to the said Richard Spittie in hand likewise payd by the said Henry Old att or before the sealing and delivery of this present Indenture the receipt whereof the said Richard Spittie doth hereby acknowledge and thereof and of every part and parcell thereof doe clearly and absolutely acquit and discharge the said Henry Old his Executors and Administrators for ever by these presents he the said Richard Spittie have granted bargained sold aliened enfeoffed released & confirmed by these presents for him and his heirs do clearly and absolutely grant bargain sell alien enfeoffe release and confirme unto the said Henry Old  

all the wood and parcell of woodland and ground comonly called or known by the name of Kingell wood or howsoever the same was or now is called or known containing by estimacon two and twenty acres or thereabouts with the appurtenances lying and being in the parish of Hockley in the County of Essex lying or near adjoining unto the same now in the tenure or possession of the said Richard Spittie his assignee or assigns And all the wood underwood tymber and trees whatsoever standing growing or being and which hereafter should stand grow renew or be in or upon the same And said wood and parcel of woodland and ground aforesaid doth abut or lye in the North side or North part of the Comon called Clements Comon att near or towards the North East and or North East parte of the said Comon together with liberty and pasage thereinto or into and from the same leading used or accustomed in by from and into the street or o Queens Highway there called Green Street And which said Wood and parcell of woodland and ground aforesaid formerly was parcell of the Demeasnes of or belonging to the Mannor Capitall messuage of farme called Plomborowe or whatsoever the same was called in Hockley aforesaid and was or had been accounted to be part or parcell of or belonging to the said Manor Capitall messuage of farm aforesaid  

And also the reversion and reversions remainder and remainders of all & singular the said mentioned to be bargained or demised premises and of every part and parcell thereof And also all rents and yearly profits whatsoever reserved due or payable and which hereafter should grow due or payable of or upon the said mentioned to be bargained or demised premises or any parte or parcell of the same  

To have & to hold the same and all and singular other the hereditaments and premises whatsoever hereby bargained or sold or mentioned to be bargained or sold with their and every of their appurtenances unto the said Henry Old his heirs and assigns forever to the only proper use and behoofe of the said Henry Old his heirs and assigns forever more And the said Richard Spittie and his heirs the said wood underwoods woodland ground timber trees hereditaments and other the premises hereby granted or released or mentioned or intended to be hereby granted or released and every part and parcell thereof unto the said Henry Old and his heirs against him ye sd Richard Spittie and his heirs and against the heirs and assigns of Ambrose Spittie deceased late father to the said Richard Spittie partie to these presents And agst the heirs and assigns of Richard Spittie late of Bromfield in the said Countie of Essex Gent sometime since likewise deceased shall and will warrant and for ever defend by these presents And the said Richard Spittie for himself his heirs executors administrators and for every of them doth covenant promise and grant to and with the said Henry Old his heirs and assigns by these presents that the said Henry Old his heirs and assigns and his and their farmers and tennants shall or lawfully may from time to time and att all and every time and times hereafter for ever freely quietly and peaceably have hold occupy possess and enjoy all and singular the said woods underwoods ground timber trees hereditaments and premises hereby granted or mentioned to be granted and every part and parcell thereof with all and singular their and every of their appurtenances and all and every the rents revenues issues profits and comodities thereof and of every part and parcell thereof have and take without any manner of lett suite trouble vexation eviction disturbance or other hindrance or molestation whatsoever of him the said Richard Spittie his heirs or assigns or of any other person or persons whatsoever any thing having or lawfully claiming or that hereafter shall or may have or lawfully claim any estate right title interest use trust benefit or demand of in or out of the said premises thereby granted or mentioned to be granted or of in or out of any parte or parcell thereof by from or under him the said Richard Spittie or of the heirs or assigns of the said Richard Spittie or of any other person whatsoever  

And moreover also the said wood underwoods woodlands ground timber trees hereditaments and premises hereby granted or mentioned to be granted and every part and parcell thereof with their and every of their appurtenances now are and from for ever hereafter shall remain continue & be unto the said Henry Old his heirs and assigns free and clear and freely clearly and absolutely acquitted freed and discharged of and from all and all manner of former and other bargains sales gifts grant joyntures dowers feofments devises uses intailes estates leases rights titles rents arrearages of rents issues fines amersiaments debts duties judgments statutes recognizances decrees sequestrations forfeitures and incumbrances whatsoever had made comitted done acknowledged or entered into by the said Richard Spittie his consent act privity knowledge or procurement or by any other person or persons whatsoever  

And lastly the said Richard Spittie for himself his heirs executors administrators and assigns and for every of them doth covenant promise and grant to and with the said Henry Old his heirs executors administrators and assigns by these presents that he shall and will att the reasonable request and proper costs and charges in the law of the said Henry Old his executors administrators and assigns make and doe all and every such act and acts for the further better and more perfect assuring and conveying the inheritance of the aforesaid hereditaments and promises and all and singular other the premises with their and every of their appurtenances unto the said Henry Old his heirs executors administrators and assigns Be it by fine or fines deed or deeds recoverie or recoveries with single double or treble voucher or vouchers release or confirmation  or by all and every or any of the said waies or meanes or by any other waies or meanes in the Law whatsoever as by the said Henry Old his heirs executors administrators or assigns or by his or their Counsell learned in the Law shall be reasonably devised advised or required
