Deed – Joseph Latham & Phillip Dallie 1715

This Indenture made the first day of February Anno Dom one thousand seven hundred and fiveteen between the within named Joseph Latham of the one part and the within named Phillip Dallie of the other part

Whereas the parties above named being fully minded and agreed to make an equal partition and division of the two lotts or parcells of land within mentioned by them purchased of the within named Johannes Beekman and for avoiding all ambiguities doubts variances & contentions which might hereafter chance to arise touching or concerning the same it is hereby covenanted granted promised and agreed by and between the parties to these presents for themselves and their respective heirs that the said Joseph Latham (for the consideration of fifty shillings current money of New York in hand paid to the said Phillip Dallie before the ensealing and delivery hereof the receipt whereof he doth hereby acknowledge) shall have hold and enjoy to him and his heirs and assigns forever in severalty as his equal share partition and division of the within purchased two lotts or parcells of land & premises one moiety or equal half part of the two lotts or parcells of land within mentioned being the lott no. 11 being the western most or corner lott within mentioned next to Beekman Street & that the said Phillip Dallie shall have hold & enjoy to him and his heirs & assigns forever in severalty of his equal share partition and division of the within purchased two lotts or parcells of land within mentioned the lott no. 12 being the eastern most lott within mentioned contiguous to and adjoining to other lotts of the within named Johannes Beekman as the said lotts are now laid out and are respectively in the possession of the said Joseph Latham and Phillip Dallie and that the said partition and division of the two lotts of land so made as aforesaid shall be and ensure and shall be judged deemed & taken to be as good effectual and available in the law to all intents constructions and purposes whatsoever as any division or partition might or could have been made in any other manner or ways or could have been made in any other manner or ways whatsoever or howsoever And the said parties to the intent aforesaid do by these presents for themselves severaly & for their several & respective heirs release & confirm to each other and their respective heirs and assigns the said divided lotts of land aforesaid and all their estate right title interest which they or either of them hath or may or ought to have in all and every part share & portion of each other in the aforesaid premises according to the true intent and meaning of the aforesaid partition To have and to hold to each of the said parties to these presents & to their several and respective heirs and assigns for ever in severalty their several and respective lott of land and appurtenances thereunto belonging hereby divided according to the true intent and meaning of these presents

Memorandum that on the first day of February Anno Dom one thousand seven hundred and fifteen personally appeared before me Abraham Wendell Esq’r. one of his Majesties Justices of the Peace of the City of New York the within named Joseph Latham and Phillip Dallie & acknowledged the Deed of partition indorsed on the back side of the within written conveyance to be their voluntary act & deed to the use therewith mentioned Abra: Wendell
