Deed - John & Elizabeth DALLY - 1685

This Indenture made the sixteenth day of October anno dom 1685 and in first yeare of the reign of …. Sovereign Lord James the Second by the grace of God of England Scotland France & Ireland King defender of the faith &c Between Paulus Richards of the City of New York merchant of the one part & John Dally of Staten Island yeoman of the other part
 
Witnesseth that the said Paulus Richards for & in consideracon of the yearly rents & covenants herein after menconed on the part and behalf of the s’d John Dally his executors administrators & assigns to being paid done & performed hath demised granted & to farme letten & by these presents doth demise grant & to farme let unto the said John Dally his executors administrators & assigns all that certain lott or parcell of land now or late in the occupacon of him the said John Dally scituate lying & being on Staten Island aforesaid next & adjoining to the land of Richard Stillwell on the southwest and on the northwest on the highway under the seale of the province of New York may more att large appeare together with all & singular the houses edifices building barnes stables fences & appurtenances whatsoever thereunto belonging or in anywise appertaining
 
To have and to hold the said lott or parcell of land and other the premises with theire appurtenances unto the s’d John Dally his his executors administrators & assigns from the fourteenth day of October next ensuing the date hereof for during & untill the full end & terme of seven yeares from thence next ensuing & fully to be compleat & ended yielding & paying therefore yearly and every yeare during the said terme of seven yeares unto the said Paulus Richards his his executors administrators & assigns the yearly rent or sume of four pounds two shillings & six pence currant money of New York on the first day November in every yeare att the stone dwelling house of the said Paulus Richards in New York aforesaid and the said John Dally for himself his executors administrators & assigns & every of them doth covenant promise & grant to & with the said Paulus Richards his heirs executors & administrators & every of them by these presents in manner & forme following (that is to say) that he the s’d John Dally his executors administrators & assigns shall & will well & truly pay or cause to be paid unto the said Paulus Richards his executors administrators or assigns the said yearly rent or sume of foure pounds two shillings & six pence att the day & time before therein limited for the payment thereof of and allsoe shall & will from time to time & att all times hereafter during the said terme of seven yeares when & as often as need shall be or required att his or theire own proper costa & charges well & sufficiently repaire maintain amend & keep the hedges ditches fences of or belonging to the said demised let or parcell of land & all other the premises herein before demised and the s’d let or parcell of land hedges ditches fences & all other the premises herein before demised in as good state & condicon as they now are (reasonable use & wearing thereof only excepted) att the end of the said terme of seven yeares or other sooner determination of this present demised shall & will peaceably & quietly leave surrender and yield up unto the s’d Paulus Richards his heirs executors administrators or assignes provided that it it shall happen the s’d yearely rent or sume of four pounds two shillings & six pence or any part thereof be behind or unpaid by thee space of fourteen days next over or after any of the days or times whereon the same ought to be paid as aforesaid (being lawfully demanded) then & from thence forth it shall & may be lawfull to & for the said Paulus Richards his executors administrators or assignes into the said demised premises or any part thereof in the name of the whole wholely to reenter & the same to have again retain reposses & enjoy as in his & theire first & former state & the said John Dally his executors administrators & assignes & all other the occupyiers of the premises thereout & from thence …rly to expel putt out & amove anything before in these presents contained to the contrary thereof in anywise notwithstanding and the said Paulus Richards for himself his heires executors administrators & assignes doth covenant promise & grant to & with the said John Dally his executors administrators & assignes & every of them by these presents that he the said John Dally his executors administrators & assignes observing performing fulfilling paying keeping all & singular the covenants charges rents & agreement herein beforemenconed on his & theire parts & behalfes to be observed performed fulfilled paid & kept shall & may peaceably & quietly have hold occupy possess & enjoy all & singular the herein before demised premises with theire appurtenances & every part & parcell thereof without the lawfull let trouble eviccon …… disturbance or interrupcon of him the said Paulus Richards his heires executors administrators or assignes or any of them And it is hereby further covenanted & agreed between the s’d parties to these presents that if the said John Dally his heires executors administrators or assignes or any of them doe & shall att any time within the said terme of seven yeares will & truly pay & cause to be paid unto the said Paulus Richards his heires executors administrators or assignes the full & just sume of eighty two pounds ten shillings currant money of New York & doe & shall in the mean time well & truly pay or cause to be paid the said yearely rent of four pounds two shillings and six pence above herein referred that then & in such case the said Paulus Richards his heires executors administrators & assignes shall & will by good & sufficient coveyances & assurances in the law convey and assure the herein before demised premises unto the s’d John Dally his heires & assignes for ever att the proper costs & charges in the law of the s’d John Dally his heires & assignes But it shall happen the said John Dally his heires executors & administrators or assigns shall not pay or cause to be paid unto the said Paulus Richards his heires executors & administrators or assigns the said sum of eighty two pounds and ten shillings together with the said yearely rent of foure pounds two shillings and six pence that when the s’d John Dally his heires executors & administrators or assignsor any of them shall not have or pretend to have any claime or right to any such messuages tenements ereccons buildings or other improvements whatsoever as shall be erected built or made upon the premises or any part thereof by the s’d John Dally his heires executors & administrators or assigns or any of them att any time during the said terme of seven yeares but that the same shall remaine & be to the s’d Paulus Richards his heires & assignes for ever together with & as part of the herein before demised premises
