Dr. John Stites - property dealings

Recorded in and at the request of Mr. Ebenezer Haviland this 11th day of March 1789 

This Indenture made the third day of February in the year of our Lord one thousand seven hundred and eighty nine between John Stites of the State of New Jersey Merchant and Susannah his wife of the one part and Ebenezer Haviland of the City of New York Merchant of the other part 

Witnesseth that the said John Stites and Susannah his wife for and in consideration of the sum of one thousand one hundred and fifty pounds current money of the State of New York to them in hand paid by the said Ebenezer Haviland at and immediately before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged have granted bargained sold aliened released and confirmed and by these presents do grant bargain sell alien release and confirm unto the said Ebenezer Haviland in his actual possession now being by virtue of a bargain and sale to him thereof made for one whole year by Indenture bearing date the day next before the day of the date of these presents and by force of the Statute for transferring uses into possession and to his heirs and assigns forever 

All that certain dwelling house and lot of ground situate in Montgomery Ward of the said City of New York bounded as follows
in front upon Queen Street
Easterly by Beekman Street
in the rear by ground of the said John Stites and
Westerly by a house and ground of Benjamin Haviland
containing in breadth and front twenty three feet and five inches and containing the same breadth backwards from Queen Street aforesaid thirty six feet and nine inches at which distance it becomes twenty five feet and three inches in breadth and extends the same breadth to the end of the lot and containing in length on both sides from Queen Street aforesaid one hundred feet as appears by the annexed map

Together with all and singular the edifices buildings improvements ways easements waters water courses profits emoluments hereditaments and appurtenances to the said hereby granted belonging or in any wise appertaining And also all the estate right title interest dower claim and demand both in law and equity of them the said John Stites and Susannah his wife and of their respective heirs and assigns of in and to the same and every part thereof with the appurtenances and the reversion and reversions remainder and remainders rents issues and profits thereof with the appurtenances To have and to hold all and singular the said dwelling house and lot of ground and premises hereby granted with the hereditaments and appurtenances and every part thereof unto the said Ebenezer Haviland his heirs and assigns to the only proper use and behoof of the said Ebenezer Haviland his heirs and assigns forever 

And the said John Stites for himself his heirs and assigns doth hereby covenant grant to and with the said Ebenezer Haviland his heirs and assigns that he the said John Stites now hath in himself good right and lawful and absolute authority to grant alien and convey the said dwelling house and lot of ground and premises hereby granted or intended to be granted with the appurtenances and hereditaments and every part thereof unto the said Ebenezer Haviland his heirs and assigns in manner and form aforesaid And also that he the said Ebenezer Haviland his heirs and assigns shall or lawfully may from time to time and at all times forever hereafter peaceably have hold occupy use possess and enjoy the said dwelling house and lot of ground above mentioned and premises hereby granted with their and every of their appurtenances without any manner of let suit trouble eviction hindrance or molestation whatsoever of or by the said John Stites his heirs and assigns or any other person or persons whatsoever lawfully claiming or to claim the said dwelling house  and lot of ground and premises hereby granted and any part thereof And that the said dwelling house and lot of ground and premises hereby granted with their and every of their appurtenances are free and clear of and from all former and other gifts grants bargains sales feofments leases wills dowers mortgages and all other incumbrances whatsoever 

And lastly that he the said John Stites and his heirs the aforesaid dwelling house and lot of ground and premises hereby granted unto the said Ebenezer Haviland his heirs and assigns against the said John Stites his heirs and assigns and against all and every other person and persons whatsoever shall and will warrant and forever defend by these presents 

In witness whereof the parties to these presents have hereunto interchangeably set their hands and seals the day and year above written

Sealed and delivered in the presence of the words “one hundred feet” being first interlined between the ninth and tenth lines and the word “dower” also interlined the word “third” on the first line wrote on an erasure

Received on the day of the date of the within Indenture from the within named Ebenezer Haviland the full consideration money therein expresses

Be it remembered that on the twenty fifth day of February in the year of our Lord one thousand seven hundred and eighty nine personally appeared before me John Ray one of the Masters in Chancery for the State of New York the within named John Stites and Susannah his wife and the said John Stites acknowledged that he sealed and delivered the within release as his voluntary act and deed for uses within mentioned And the said Susannah Stites being also examined by me apart from her husband acknowledged that she sealed and delivered the within release as her voluntary act and deed for the uses within mentioned without any fear threat or compulsion from her said husband and I having inspected the same and finding no razures or interlineations therein but those noted Do allow the same to be recorded
