Henry Hendrix a.k.a Henry Francis
to
Judith Brasher 

This Indenture made the seventh day of April in the twelfth year of the reign of our Sovereign Lord George the second by the grace of God of Great Britain France and Ireland King Defender of the Faith &c. and in the year of our Lord one thousand seven hundred and thirty nine 

Between Henry Hendrix otherwise called and commonly known by the name of Henry Francis of the City of New York Ship Carpenter of the one part and Judith Brasher of the same City Widow of the other part 

Witnesseth that for and in consideration of the sum of two hundred and eighty pounds current money of the Colony of New York to the said Henry Hendrix or Henry Francis in hand well and truly paid at or before the ensealing and delivery of these presents by the said Judith Brasher the receipt whereof he the said Henry Hendrix or Henry Francis doth hereby acknowledge and himself therewith fully satisfied contented and paid thereof and of and from every part and parcel thereof doth acquit release exonerate and discharge the said Judith Brasher her heirs executors administrators  and assigns and every of them forever by these presents the said Henry Hendrix or Henry Francis hath granted bargained sold conveyed assured remised released and confirmed and by these presents doth grant bargain sell convey assure remise release and confirm unto the said Judith Brasher (in her actual possession now being by virtue of a bargain and sale to her made by the said Henry Hendrix or Henry Francis by Indenture bearing date the next before the day and date of these presents for the term of one whole year commencing from the day next before the day of the date of the same Indenture and by force and virtue of the Statute of Transferring uses into possession) and to her heirs and assigns forever 

All that certain dwelling house messuage or tenement and lot or parcel of ground situate lying and being within the City of New York in the East Ward of the same City on the West side of a certain Street commonly called or known by the name of Wall Street bounded Southerly by the house and ground of the said Judith Brasher Northerly by the house and grounds in the tenure of Doctor John Nicholl and Easterly by the said Wall Street containing in breadth in the front and in the rear at each end thirty foot wood measure in length on the South side nine rod and three foot and in length on the Northerly side ten rod and six foot like measure 

Together with all and singular ways passages lights easements kitchens out houses wells waters water courses setters solars chambers edifices buildings gardens fences profits commodities advantages hereditaments and appurtenances whatsoever to the said hereby bargained and released dwelling house messuage or tenement and lot or parcel of ground or other the premises belonging or in any wise appertaining or therewith  used occupied or enjoyed or accepted reputed taken or known demised leased or let as part parcel or member thereof and the reversion and reversions remainder and remainders rents issues and profits of all and singular the premises and of every part and parcel thereof and also all the estate right title interest possession reversion claim property and demand whatsoever of him the said Henry Hendrix or Henry Francis of in or to the said dwelling house messuage or tenement and lot or parcel of ground and premises or any part or parcel thereof or in any wise howsoever together with all the deeds charters muniments scripts evidences and writings touching or concerning the premises only or only any part thereof now in the custody or power of the said Henry Hendrix or Henry Francis and true copies of all and such as concern the premises jointly with other things 

To have and to hold the said dwelling house messuage or tenement and lot or parcel of ground and all and singular the premises aforesaid in and by these presents granted and released and mentioned or intended to be hereby granted and released and every part and parcel thereof with their and every of their rights members and appurtenances unto the said Judith Brasher her heirs and assigns forever to and for the only proper use benefit and behoof of the said Judith Brasher her heirs and assigns forever And the said Henry Hendrix or Henry Francis his heirs executors and administrators the said hereby granted and released dwelling house messuage or tenement and lot or parcel of ground and premises and every part and parcel thereof with their appurtenances unto the said Judith Brasher her heirs and assigns against the said Henry Hendrix or Henry Francis and his heirs and assigns and all other person and persons whatsoever shall and will warrant and forever defend by the presents 

And the said Henry Hendrix or Henry Francis for himself his heirs executors and administrators and every of them doth fully covenant promise and agree to and with the said Judith Brasher her heirs and assigns and every of them by these presents in manner and form following (that is to say) that for and not withstanding any act matter or thing by him the said Henry Hendrix or Henry Francis done or committed to the contrary he the said Henry Hendrix or Henry Francis on the day of the date hereof and at the time of the ensealing and delivery of these presents is and standeth lawfully seized in his demesne of an absolute and indefeasible estate of inheritance in fee simple to him and his heirs and assigns of and in the said dwelling house messuage or tenement and lot and parcel of ground and premises herein before mentioned or intended to be hereby granted and released and every part and parcel thereof without any manner of condition use trust power or limitation to alter change defeat incumber make void or determine the same 

And that he the said Henry Hendrix or Henry Francis now hath in himself full power good right true title and lawful and absolute authority to grant release and convey all and singular the dwelling house messuage or tenement and lot or parcel of ground and premises herein before mentioned or intended to be granted released or conveyed with their and every of their rights members and appurtenances unto the said Judith Brasher her heirs and assigns in manner and form aforesaid 

And that she the said Judith Brasher her heirs and assigns shall and may from time to time and at all times forever hereafter peaceably and quietly have hold occupy possess and enjoy the said dwelling house messuage or tenement and lot or parcel of ground and premises with the appurtenances and every part and parcel thereof and receive and take rents issues and profits of the same to her own and their own proper use and behoof without any lawful let suit trouble denial eviction ejection molestation impediment claim demand or interruption either in law or equity of or by the said Henry Hendrix or Henry Francis or the heirs of the said Henry Hendrix or Henry Francis or of or by any other person or persons whatsoever 

And that free and clear and freely and clearly acquitted exonerated and discharged or otherwise by the said Henry Hendrix or Henry Francis his heirs executors or administrators or some of them from time to time and at all times hereafter well and sufficiently saved defended kept harmless and indemnified of from and against all and every manner of form and other gifts grants bargain sales leases jointures dowers and title of dower and of the staple recognizances judgments extents executions fines amerciaments reliefs quit rents rent charges annuities yearly payments and all arreages thereof and of and from all other estates titles troubles charges and incumbrances thereof whatsoever had made done committed or suffered by the said Henry Hendrix or Henry Francis or any other person or persons whatsoever 

And further that the said Henry Hendrix or Henry Francis and his heirs and all and every person and persons whatsoever having and lawfully claiming or which can or may have or lawfully claim any estate right title interest benefit or demand of in to or out of the said hereby granted and released premises or any part or parcel thereof from or under him or otherwise howsoever shall and will from time to time and at all times hereafter at the reasonable request costs and charge in the law of the said Judith Brasher her heirs and assigns make do acknowledge levy suffer and execute or cause or procure to be made done acknowledged levied suffered or executed all and every such further and other lawful and reasonable act and acts thing and things deed and deeds conveyance and assurances in the law whatsoever for the further better and more perfect assuring conveying and sure making of the said hereby granted premises with and every of their appurtenances unto the said Judith Brasher her heirs and assigns forever as to her the said Judith Brasher her heirs or assigns of their counsel learned in the law shall be reasonable devised advised or required so as the person or persons required to make the same be not compelled or compellable to travel further than ten miles from his or her or their dwelling or place of abode for the doing thereof 

In witness whereof the party first above named hath hereunto set his hand and seal the day and year first above written Henry Hendrix (seal) 

Sealed and delivered in the presence of Henry De forest, S Johnson April ye 7th 1739 then received of the within named Judith Brasher two hundred and eighty pounds current money within mentioned being in full satisfaction payment and discharge of the consideration money within mentioned to be paid I say received

Memorandum that on the seventh day of May personally came and appeared before me Abraham Van Horne Esq. one of his Majesties Counsel for the Colony of New York the within named Henry Hendrix or Henry Francis and acknowledged to have executed the within Instrument or conveyance as his voluntary act and deed for the uses therein mentioned And I having examined the said instrument or conveyance and finding no raisures nor interlineations therein do allow the same may be recorded Anno Domini 1739

In the foregoing record of release Judith Brasher recorded at the request of Mr. George Burnett to wit in pg 503 line 18 the word [remise] appears to be wrote on eraisure and an eraisure not wrote on in the 23rd line and between the 10 & 11 lines of this pg the word [the] appears interlined
Examined & comp’d with the original this 8th day of May 1750.
