Dr. John Stites - property dealings

This Indenture made and concluded this sixth day of May in the year of our Lord eighteen hundred between John Stites of Elizabeth Town State of New Jersey of the one part and William Wells, Israel Ludlow and John Armstrong all of the territory of the United States North West of the river Ohio of the other part 

Witnesseth that for and in consideration of certain services by them the said William, Israel and John performed in locating land for the said John Stites, and in consideration of the sum of one dollar to the said John Stites in hand paid by the said William Wells, Israel Ludlow and John Armstrong the receipt whereof is hereby acknowledged thereof doth exonerate them the said William Wells, Israel Ludlow and John Armstrong their heirs executors administrators or assigns forever, the said John Stites hath granted bargained sold aliened released and confirmed and by these presents do grant bargain sell alien release and confirm unto the said William Wells, Israel Ludlow and John Armstrong as tenants in common and not as joint tenants their heirs and assigns forever six hundred acres of land within the tract set apart by Congress for satisfying military bounties lying and situated in a square at the North East corner of the third section of the fifth township of the fifteenth range of township which land has been patented by the United States to said John Stites bearing date the seventh day of May eighteen hundred 

To have and to hold the said granted premises with all its appurtenances unto them the said William Wells, Israel Ludlow and John Armstrong as tenants in common and not as joint tenants their heirs and assigns forever subject only to the conditions and provisions contained in the laws of the United States relative thereto, and I the said John Stites do hereby covenant with the said William, Israel and John their heirs executors administrators and assigns that at and until the ensealing hereof I the said John Stites am legally seized of the said granted premises and have good right and lawful authority to grant and convey the same in manner aforesaid and do hereby bind myself my heirs executors and administrators to warrant and defend said described premises against all lawful claims whatsoever

The words “tenants in common and not as joint tenants” between the fifteenth and sixteenth lines and between the twenty fourth and twenty fifth lines from the top were made before signing original

Personally appeared before me the subscriber one of the associate Judges of the Court of Common Pleas for the County of Philadelphia the within named John Stites and acknowledged the within Indenture his act and deed and that the same may be recorded as such

N.B. :- This deed is indexed under Stiles in the Fairfield County, Ohio deed indexes, and the deed book B-43 records his name as John Stiles in the deed. However the land in question is identical to the military grant to John Stites (GLO records OH2100_.233 – Range 15, Township 5, Quarter 3). As so often happens, his name was mis-transcribed as Stiles by the clerk. As such I have corrected the name in this transcription to prevent the error being perpetuated.
