Deed to
J. Dayton et al 

This indenture made the fourth day of February in the year of our Lord one thousand eight hundred and three between David Galbreath late of the City of New York Merchant of the one part and Jonas Stanbery and Jonathan Dayton Esqr. of the other part whereas in pursuance of several Acts of Congress heretofore passed for that purpose the President of the United States did in virtue of the powers of authority in him vested issue Letters of Patent to and in the name of the said David Galbreath and Thomas Elmes granting and conveying to them the following tracts of land to wit;
the first quarter of the seventh township in the first range
the second quarter of the first township in the eleventh range
the first quarter in the fourth township in the thirteenth range
the first quarter in the third township in the seventeenth range
the first quarter of the fifth township in the seventeenth range
and the first quarter in the sixth township in the seventeenth range
for Military Service estimated to contain twenty three thousand four hundred and thirty acres; 

And whereas the said Thomas Elmes on the eighth day of December now last past did execute Deeds of conveyance for the said land and deliver and deliver the same to the said Jonas Stanbury and Jonathan Dayton not only for himself but as Attorney for the said David Galbreath and whereas doubts have arisen whether the said Thomas Elmes was lawfully empowered to execute the said Deed of conveyance for and on behalf of the said David Galbreath 

Now this Indenture witnesseth that the said David Galbreath for and in consideration of the premises and in further consideration of the sum of one dollar to him in hand paid by the said Jonas Stanberry and Jonathan Dayton at and before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained sold conveyed and confirmed by these presents doth grant bargain sell convey and confirm unto the said Jonas Stanberry and Jonathan Dayton their heirs and assigns all the right interest and title of him the said David Galbreath of in and to the before mentioned described six quarter townships of land and to every part and parcel thereof with their appurtenances 

To have and to hold all and singular the said right interest and title of him the said David Galbreath in and to the said tracts of land and premises with the appurtenances unto the said Jonas Stanberry and Jonathan Dayton their heirs and assigns to the own proper use benefit and behoof forever And the said David Galbreath for himself his heirs executors and administrators doth covenant and agree and with the said Jonas Stanberry and Jonathan Dayton their heirs executors administrators and assigns that he the said David Galbreath and Thomas Elmes had in the said eighth day of December last in themselves full power and lawful authority to convey the said land in fee simple free and clear of all encumbrances whatsoever And that the said David Galbreath hath not since the eighth day of December last done any act or thing to alter change incumber or impair his right interest and title in the said land

On the twenty first day of April in the year one thousand eight hundred and three personally came before me John Kemp (who by the oaths of John Taylor of New York Merchant is proven to my satisfaction to be the same person) and being duly sworn did depose and say that he saw David Galbreath known to him to be the same person and who is described in and who executed the same and that he set his name thereto as a subscribing witness all which is to my satisfactory proof of its execution and finding therein no alternative I do allow it to be recorded
